Welcome to Mildist.

These Terms of Service (“Terms”) govern your access to and use of the Mildist website, including www.mildist.com, and the products, services, content, features and functionality made available through the website (collectively, the “Services”).

“Mildist”, “we”, “us” and “our” refer to Mildist, a sole proprietorship operating in India. “You”, “your” and “customer” refer to any person who accesses the Website or purchases Products through the Services.

By accessing, browsing or using the Services, or by placing an order through the Website, you acknowledge that you have read and understood these Terms and agree to be bound by them, together with the Mildist Privacy Policy and any other policies expressly incorporated into these Terms.

If you do not agree with these Terms, please do not use the Services.

2. ELIGIBILITY

You may use the Services and place orders only if you are legally capable of entering into a binding contract under applicable Indian law.

If you are under 18 years of age, you may use the Website only under the supervision and involvement of a parent or legal guardian who is legally competent to enter into a binding contract.

You agree that information provided by you in connection with an order must be accurate, complete and current.

Mildist may decline or cancel an order where information provided is materially false, misleading, fraudulent or insufficient to fulfill the order.

3. PRODUCTS AND PERSONAL USE

Mildist Products are intended for personal use unless expressly stated otherwise.

You may not resell, redistribute, commercially exploit or list Mildist Products on third-party marketplaces or other commercial channels without prior written authorization from Mildist.

Mildist may limit quantities or decline orders where it reasonably believes that an order involves unauthorized resale, commercial distribution, fraud, abuse or other misuse of the Services.

Mildist may modify, replace, suspend or discontinue Products from time to time. Where an affected Product has already been ordered and accepted by Mildist, applicable consumer rights and refund obligations will continue to apply.

4. COSMETIC PRODUCTS AND SAFE USE

Mildist Products are cosmetic and personal-care products intended solely for external use unless expressly stated otherwise on the applicable Product packaging.

Products must be used strictly in accordance with the instructions, warnings and directions provided on the Product packaging or accompanying materials.

Products should be kept out of reach of children unless specifically indicated for child use.

Mildist Products are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Customers should review the complete ingredient list and directions for use before using a Product.

Where appropriate, customers may perform a patch test before full application. If significant irritation or an adverse reaction occurs, discontinue use and seek appropriate professional advice where necessary.

Customers with known allergies, diagnosed skin conditions or specific medical concerns should seek appropriate professional medical or dermatological advice before using a Product.

Individual cosmetic results may vary depending on factors including skin type, individual sensitivity, environmental conditions, lifestyle and usage.

Nothing in these Terms excludes or limits any rights or remedies available to consumers under applicable law in relation to defective, unsafe or improperly represented Products.

5. PRODUCT INFORMATION AND CLAIMS

Information provided on the Website, including Product descriptions, ingredient information, images, claims, testimonials, reviews and educational content, is provided for general cosmetic and informational purposes.

Nothing on the Website constitutes medical, dermatological or professional healthcare advice.

Mildist makes reasonable efforts to ensure that Product information is accurate and current.

Product photographs are provided for illustrative purposes. Actual packaging, color, texture, finish or appearance may vary slightly due to lighting, screen settings, manufacturing variations or packaging updates.

Testimonials, reviews, before-and-after representations and customer experiences reflect individual experiences and do not constitute a guarantee that another customer will achieve the same results.

Mildist does not guarantee a particular cosmetic result for every individual.

Mildist's Product descriptions and claims are intended to accurately reflect the characteristics and intended use of the Products.

6. PRODUCT AVAILABILITY

All Products are subject to availability.

We make reasonable efforts to keep Product availability information current. However, inventory or technical errors may occasionally occur.

If a Product becomes unavailable after an order has been placed, Mildist may cancel the affected Product or order and provide the applicable refund.

Mildist may limit quantities or discontinue Products from time to time.

7. PRICES, TAXES AND PROMOTIONS

Prices displayed on the Website are in Indian Rupees (INR).

Unless expressly stated otherwise, prices displayed on the Website are inclusive of applicable taxes, including GST.

Any applicable delivery charges or other charges will be displayed before you complete your purchase.

Prices and promotional offers may change from time to time. Such changes will not affect an order that has already been accepted by Mildist, except where cancellation is permitted under these Terms or applicable law.

Mildist takes reasonable care to ensure that prices and Product information displayed on the Website are accurate. If a material pricing or technical error affects an order, Mildist may cancel the affected order and provide the applicable refund.

Promotional offers, discount codes, complimentary Products and other promotional benefits may be subject to additional terms, eligibility requirements, Product restrictions, usage limits or expiry dates.

Unless expressly stated otherwise, promotional offers cannot be combined with other offers.

Mildist may withdraw or modify a promotion where reasonably necessary, including in cases of fraud, misuse or technical error.

8. ORDERS AND ORDER ACCEPTANCE

When you submit an order through the Website, you are offering to purchase the selected Products.

Submission of an order does not by itself guarantee acceptance of the order.

Orders are subject to Product availability, payment authorization, verification and acceptance by Mildist.

Mildist may decline or cancel an order where reasonably necessary, including because of:

  • Product unavailability;
  • a material pricing or technical error;
  • payment failure;
  • suspected fraud or payment abuse;
  • inaccurate or incomplete information;
  • duplicate or unusual orders;
  • suspected unauthorized resale; or
  • circumstances beyond Mildist's reasonable control.

If an order is cancelled after payment has been received, Mildist will initiate the applicable refund through the original payment method or another appropriate payment mechanism.

9. PAYMENT

Payments are processed through authorized third-party payment service providers.

Mildist does not ordinarily receive or store complete payment-card information. Payment information may be processed by the applicable payment service provider in accordance with its own terms and privacy practices.

By placing an order, you confirm that the payment method used is authorized for your use and that the information submitted is accurate.

Mildist may cancel or suspend a transaction where there are reasonable grounds to suspect payment fraud, unauthorized use, chargeback abuse or other fraudulent activity.

Payment-provider terms may also apply to your transaction.

10. ORDER CANCELLATION

You may request cancellation of an order before it has been processed for dispatch, subject to operational feasibility.

Once an order has been dispatched, cancellation may no longer be possible. In such cases, the applicable return, refund or replacement process will apply.

Mildist may cancel an order in accordance with these Terms, including where Products are unavailable, a material pricing or technical error has occurred, payment cannot be verified, fraud is suspected, or fulfilment is not reasonably possible.

Where Mildist cancels a prepaid order, the applicable refund will be initiated through the original payment method or another permitted payment mechanism.

Nothing in this section limits any cancellation, return or refund rights available under applicable law.

11. SHIPPING AND DELIVERY

Mildist delivers to locations serviced by its logistics partners.

Delivery timelines displayed on the Website or communicated after order placement are estimates unless expressly stated otherwise.

Delivery may be affected by factors including:

  • courier operations;
  • weather;
  • transportation disruptions;
  • public holidays;
  • governmental restrictions;
  • remote delivery locations;
  • incorrect or incomplete delivery information; and
  • events beyond Mildist's reasonable control.

Customers are responsible for ensuring that the delivery information provided at checkout is complete and accurate, including the recipient's name, address and contact details reasonably required for delivery.

Where a delivery failure or additional delivery attempt is caused by inaccurate, incomplete or incorrect information supplied by the customer, Mildist may be unable to complete the delivery and may recover reasonable re-delivery or related costs where permitted by applicable law and disclosed to the customer.

Mildist will not treat ordinary courier delays or failures outside the customer's control as the customer's responsibility.

Where available, tracking information will be provided after dispatch.

12. RETURNS, REFUNDS AND REPLACEMENTS

Returns, refunds and replacements are governed by the Mildist Return & Refund Policy, which forms part of these Terms.

For hygiene, safety and product-integrity reasons, opened or used skincare Products will generally not be eligible for return where accepting the Product back would be inconsistent with applicable hygiene or safety requirements.

Customers should contact Mildist as soon as reasonably practicable after delivery and, where possible, within 48 hours of delivery for visible damage, incorrect Products or transit-related issues.

The 48-hour reporting period is intended to facilitate prompt investigation and does not exclude any consumer right or remedy that cannot lawfully be excluded under applicable law.

Customers may be asked to provide reasonable information or evidence necessary to investigate a claim, including order details, photographs, videos, shipping information or Product/batch information.

Where a refund is approved, Mildist will ordinarily initiate the refund through the original payment method. The time taken for the refunded amount to appear in the customer's account may depend on the relevant bank, card network or payment provider.

Nothing in this section limits any mandatory consumer right or remedy under applicable law.

13. INTELLECTUAL PROPERTY

All intellectual property associated with Mildist, including trademarks, logos, Product names, packaging, designs, formulations, website layouts, text, graphics, photographs, videos, campaigns, brand identity and marketing materials, is owned by or licensed to Mildist and is protected under applicable law.

Except as expressly permitted by these Terms or with prior written permission from Mildist, you may not:

  • copy;
  • reproduce;
  • modify;
  • publish;
  • distribute;
  • commercially exploit;
  • scrape;
  • reverse engineer;
  • create derivative works from; or
  • otherwise misuse

Mildist's intellectual property.

Nothing in these Terms transfers ownership of Mildist's intellectual property to you.

14. WEBSITE USE AND ACCEPTABLE USE

Subject to your compliance with these Terms, Mildist grants you a limited, revocable, non-exclusive and non-transferable right to access and use the Website for lawful, personal and non-commercial purposes.

You must not:

  • reproduce or republish substantial portions of the Website for commercial purposes;
  • modify or create derivative works from Website content;
  • use automated systems, bots, spiders, crawlers or scraping tools to extract Website data;
  • interfere with Website security or operation;
  • attempt to gain unauthorized access to Website systems, accounts or data;
  • conduct automated purchasing or abusive transactions; or
  • use the Website for unlawful, fraudulent or deceptive purposes.

Mildist may restrict or suspend access where it reasonably believes these Terms have been materially breached.

15. USER-GENERATED CONTENT

If you voluntarily submit or make available reviews, testimonials, photographs, videos, comments, social-media content or other materials relating to Mildist (“User Content”), you retain ownership of that User Content.

By voluntarily submitting User Content to Mildist or publicly tagging or identifying Mildist in content that you have made available for public viewing, you grant Mildist a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, adapt and distribute that User Content for legitimate brand, marketing, advertising and business purposes.

You represent that:

  • you own or have the necessary rights to the User Content;
  • the User Content does not infringe another person's rights;
  • you have obtained any permissions reasonably required from identifiable persons appearing in the content; and
  • the User Content is not unlawful, fraudulent, misleading, defamatory or otherwise prohibited by applicable law.

Mildist may choose not to publish or may remove User Content where reasonably appropriate.

16. THIRD-PARTY SERVICES AND LINKS

The Services may contain links to or integrations with third-party services, including payment providers, logistics providers, analytics services, social-media platforms and external websites.

Third-party services are governed by their own terms and privacy policies.

Mildist does not control third-party websites or services and is not responsible for their content, policies, security or operational practices, except where liability cannot lawfully be excluded.

A link to a third-party website does not necessarily constitute an endorsement by Mildist.

17. PRIVACY AND ELECTRONIC COMMUNICATIONS

Your use of the Services is also governed by the Mildist Privacy Policy.

The Privacy Policy explains how Mildist collects, uses, stores and otherwise processes personal information in connection with the Services.

Mildist may communicate with you electronically in relation to your orders, payments, delivery, refunds, customer support, policy updates and other transactions.

Transactional communications are separate from optional marketing communications.

Any rights relating to personal information and marketing communications will be handled in accordance with the Mildist Privacy Policy and applicable law.

18. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the Website is provided on an “as is” and “as available” basis.

Mildist does not warrant that:

  • the Website will always be available;
  • access will always be uninterrupted or error-free;
  • all Website information will always be complete or current; or
  • technical issues will always be corrected immediately.

Mildist does not guarantee that every Product will produce a particular cosmetic result for every individual.

Nothing in these Terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded or limited under applicable law.

19. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Mildist will not be liable for indirect, incidental, special or consequential losses arising solely from your use of the Website or Services.

Subject to applicable law, Mildist's aggregate contractual liability arising from a particular order will not exceed the amount actually paid by the customer for the Product giving rise to the claim.

Nothing in these Terms excludes or limits:

  • liability that cannot lawfully be excluded or limited;
  • mandatory consumer rights or remedies;
  • liability arising from fraud or willful misconduct; or
  • rights or remedies available under applicable product-safety or consumer-protection laws.

20. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to indemnify Mildist, its proprietor and its service providers against third-party claims, losses and reasonable costs arising directly from:

  • your material breach of these Terms;
  • your unlawful use of the Services;
  • your fraud or willful misconduct;
  • infringement of a third party's rights through User Content submitted by you; or
  • your violation of applicable law.

This obligation will not apply to the extent a claim results from Mildist's own unlawful conduct or liability that cannot legally be transferred to you.

21. FORCE MAJEURE

Mildist will not be responsible for delay or failure to perform an obligation where such delay or failure results from circumstances beyond its reasonable control, including natural disasters, severe weather, pandemics, governmental restrictions, transportation disruption, labour disputes, supply-chain disruption, internet or utility failures, cyber incidents, acts of war or terrorism, or other comparable events.

Mildist will take reasonable steps to resume affected obligations when circumstances permit.

22. SUSPENSION AND TERMINATION

Mildist may suspend or restrict access to the Website where it reasonably believes that a user has materially breached these Terms, engaged in fraud, violated applicable law, abused the Services or created a material security risk.

Any termination or suspension will not affect rights or obligations that accrued before termination.

Provisions relating to intellectual property, payment obligations, liability, indemnification, governing law and other provisions which by their nature should survive termination will continue to apply.

23. CUSTOMER SUPPORT AND COMPLAINTS

Nothing in this section limits any statutory right or remedy available to a consumer.

24. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India.

Subject to applicable consumer-protection laws and any mandatory jurisdictional requirements, disputes arising from these Terms or the Services shall be subject to the jurisdiction of courts having lawful jurisdiction over Mildist's place of business in Maharashtra, India.

Nothing in these Terms is intended to prevent a consumer from exercising a mandatory right or remedy available under applicable law.

25. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

26. WAIVER

Failure by Mildist to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other right.

27. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without Mildist's prior written consent.

Mildist may assign or transfer its rights and obligations in connection with a lawful business transfer, restructuring, merger, acquisition or similar transaction.

28. ENTIRE AGREEMENT

These Terms, together with the Mildist Privacy Policy, Return & Refund Policy, Shipping Policy and any other policies expressly incorporated by reference, constitute the agreement governing your use of the Services and supersede prior representations concerning the same subject matter, except where a separate written agreement expressly applies.

29. CHANGES TO THESE TERMS

Mildist may update these Terms from time to time.

The updated version will be published on the Website with a revised “Last Updated” date.

Changes will generally apply prospectively from the date they become effective.

Where applicable law requires additional notice of a material change, Mildist will provide such notice in an appropriate manner.

Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.
